A. Scope

This Forum Policy (“Policy”) governs the use of this website operated by Pyth Data Association, Grabenstrasse 25, 6340 Baar, Switzerland (“PDA”, “we”, “us”, or “our”), in particular the domain https://forum.pyth.network/ and all subdomains related to it (hereinafter jointly referred to as “Forum”).

“You”, “your” and “user(s)” refers to anybody who accesses or uses our Forum in any way. If you are accessing or using the Forum on behalf of a company (such as your employer) or other legal entity, you represent and warrant that you have the authority to bind that entity to this Policy and, in that case, “you”, “your” or “user(s)” will refer to that entity.

Please read the Policy carefully before you start to use the Forum. By using the Forum or by clicking to accept or agree to the Policy when this option is made available to you, you accept and agree to be bound and abide by this Policy in addition to:

B. Changes to the Forum Policy

This Policy may be changed at any time at our sole discretion and without prior notice. All changes are effective immediately upon posting. By continuing to use the Forum after revised Policy have been posted, you signify your acceptance of and agreement to the changes.

You are responsible to regularly review this Policy to stay informed of any updates, as it is legally binding on you.

C. Accessing the Forum

We reserve the right to modify or discontinue the Forum, along with any services or materials offered on it, at our sole discretion and without prior notice. We do not guarantee continuous availability or uninterrupted access to our Forum or its content. We will not be liable if all or any part of the Forum is unavailable at any time or for any duration. Periodically, we may limit access to certain sections of the Forum or the entire Forum for users.

You are responsible to:

  • make all necessary arrangements to access the Forum; and
  • ensure that anyone who accesses the Forum through your internet connection is aware of and complies with this Policy.

D. Personal Restrictions

Our Forum is accessible to users who are at least 18 years old. The Forum is not meant for individuals under 18. By accessing and using the Forum, you confirm and guarantee that you (i) are 18 years old or older, (ii) are not prohibited from using the Forum by any relevant laws, and (iii) are using the Forum solely for personal purposes. If you do not fulfill these criteria, you are not permitted to access or use the Forum.

E. Local Restrictions

We are based in Switzerland and do not make any claims that the Forum or any of its content is accessible or appropriate outside of Switzerland. Access to the Forum may be illegal for certain individuals or in certain countries. If you choose to access the Forum from outside Switzerland, you do so at your own risk and are responsible for complying with local laws.

F. Your Account and Account Security

To access the Forum or some of the resources it offers, you may be required to provide certain registration details or other information. It is a condition of your use of the Forum that all information you provide is accurate, current, and complete. You agree that all information you provide to use the Forum, including any interactive features, is governed by our Privacy Policy, and you consent to all actions we take concerning your information that are consistent with the Privacy Policy and this Policy.

You must create and log into an account to use some features of the Forum. To create an account, you must provide some information about yourself. If you create an account, you agree to provide, at a minimum, a valid e-mail address, and to keep that address up to date. You may close your account at any time by contacting us (forum-requests@pyth.network).

Each user is permitted to maintain only one account. Creating multiple accounts is prohibited and may result in the suspension or termination of all associated accounts.

You agree to be responsible for all actions taken using your account, whether authorized by you or not, until you either close your account or notify PDA that your account has been compromised. You agree to notify PDA immediately if you suspect your account has been compromised.

You also agree to select a secure password for your account and keep it confidential. You are responsible for taking appropriate action to protect your hardware and data from viruses, malicious software, and any inappropriate material. We are not responsible for any claim or losses resulting from your failure to comply with this clause.

At all times, you must maintain adequate security and control of all of your access credentials, including your account password and any other login information. You agree to take the necessary security measures to protect your account, including but not limited to:

  • strictly abiding by all of our mechanisms or procedures;
  • creating a strong password and maintaining security and control of access to your account;
  • keeping the email account and means of communication (as requested) provided to us up to date in order to receive any notices or alerts that we may send you;
  • never allowing remote access or sharing your computer and/or computer screen with someone else when you are logged into your account;
  • remembering that under no circumstances will we ask you to share your passwords; and
  • logging out from the Forum at the end of each visit.

It is important that you monitor your account activity to identify any unauthorized or suspicious activity on your account. You acknowledge that any security breach may result in unauthorized access to your account by third parties and the loss or theft of any data and/or content associated with your account.

When personal information on the Forum from a public or shared computer, exercise particular caution to ensure that others cannot view or record your personal information.

If you suspect a security breach, you must:

  • notify us immediately using the contact details provided and continue to provide accurate and up-to-date information throughout the duration of the security breach;
  • immediately lock your account on the Forum or via any other method prescribed by us; and
  • take any other steps that we may reasonably require to reduce, manage, or report any security breach.

We reserve the right to request, and you agree to promptly provide, any and all information and documents we deem relevant or necessary in connection with an actual or suspected security breach. You further acknowledge and agree that we may provide such information to any third party that we deem necessary to investigate or resolve any security breach.

We may restrict, suspend, or close your account on the Forum for handling copyright-related takedown requests or if we reasonably believe that you have broken any rule of this Policy.

You may close your account at any time by contacting us (forum-requests@pyth.network).

G. Password Security

To enhance the security of your account, it is crucial to select a strong, unique password and store it securely. Consider the following guidelines for password security (if possible):

  • use a combination of uppercase and lowercase letters, numbers, and special characters;
  • avoid using easily guessable information, such as birthdays or common words;
  • do not share your password with anyone;
  • use a reputable password manager to store and manage your passwords securely; and
  • change your password regularly and immediately if you suspect it has been compromised.

When entering the password to your account or on the Forum from a public or shared computer, exercise particular caution to ensure that others cannot view or record your password.

H. Prohibited Uses

You may use the Forum only for lawful purposes and in accordance with this Policy. Specifically, you agree not to use (or attempt to use) the Forum:

  • in any manner that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries);
  • for any purpose that violates this Policy or any other terms or policies provided in connection with the Forum;
  • to disable, avoid, or circumvent any security or access restrictions of the Forum;
  • to exploit, harm, or attempt to exploit or harm minors in any way, including exposing them to inappropriate content or asking for personally identifiable information;
  • to send, knowingly receive, upload, download, use, or re-use any material that does not comply with this Policy;
  • to transmit or procure the sending of any advertising or promotional material without our prior written approval, including any “junk mail”, “chain letters”, “spam,” or any other similar solicitation;
  • to send advertisements, chain letters, or other solicitations, or to gather addresses or other personal data for commercial mailing lists or databases;
  • to send email to distribution lists, newsgroups, or group mail aliases through the Forum;
  • to hyperlink to images or other non-hypertext content on the Forum from other webpages;
  • to impersonate or attempt to impersonate PDA, one of our employees, another user, or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing);
  • to falsely imply affiliation with or endorsement by PDA;
  • to impersonate others through the Forum;
  • to use or attempt to use another person’s account on the Forum without their specific permission;
  • to create or maintain more than one account per user;
  • to engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Forum, or which, as determined by us, may harm PDA or users of the Forum or expose them to liability;
  • to buy, sell, or trade usernames or other unique identifiers on the Forum;
  • to damage, disable, disrupt, overburden, or impair the functionality of the Forum in any manner;
  • to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Forum, the server(s) on which the Forum is stored, or any server, computer, or database connected to the Forum;
  • to introduce any viruses, trojan horses, worms, logic bombs, malware, ransomware, spyware, or other malicious or technologically harmful material;
  • to attack the Forum via a denial-of-service attack or a distributed denial-of-service attack;
  • to harvest or otherwise collect information or data about any person without their consent or use automated scripts to collect information from or otherwise interact with the Forum;
  • to commercialize any application, code, or any information or software associated with such application and/or the Forum, without our prior consent;
  • to automate access to the Forum, or to monitor the Forum with any computer program that is not a web browser, except for indexing the Forum for a publicly available search engine;
  • to upload, post, transmit, distribute, store, or otherwise make publicly available on the Forum any personal data of any third party without the person’s prior explicit consent;
  • to upload, post, transmit, distribute, store, or otherwise make available content that would constitute, encourage, or provide instructions for a criminal offense or, in the sole judgment of PDA, is objectionable or misleading;
  • to strain the infrastructure of the Forum with an unreasonable volume of requests or requests designed to impose an unreasonable load on information systems;
  • to remove any marks indicating proprietary ownership from materials downloaded from the Forum;
  • to display any part of the Forum on other websites using iframe
  • to circumvent or attempt to circumvent any filtering, security measures, or other features designed to protect the Forum, or third parties; and
  • to facilitate or assist another person to do any of the above acts.

If you become aware of any unauthorized or unacceptable use of the Forum, you agree to promptly notify us (forum-requests@pyth.network).

I. Content Standards

When using the Forum, you agree not to submit any content that:

  • is illegal, offensive, or otherwise harmful to others. This includes content that is harassing, inappropriate, abusive, defamatory, libelous, slanderous, or incites hatred;
  • violates any laws, infringes on intellectual property rights, violates privacy, or breaches agreements you have with others;
  • contains malicious computer code, such as viruses, spyware, or any other harmful software;
  • is submitted as a placeholder to hold a particular address, user name, or other unique identifier;
  • discloses information that you do not have the right to disclose, including others’ confidential or personal information;
  • strays off-topic from the original subject of the discussion, including questions and comments unrelated to the topic;
  • disrespects other users, individuals mentioned in articles, PDA, or one of our employees, including making derogatory remarks about someone’s appearance or name;
  • lacks substantiated arguments, fails to cite credible sources, or includes unfounded allegations or accusations;
  • spreads misinformation or false information, including unverifiable claims;
  • includes discriminatory or defamatory remarks based on race, gender, sexual orientation, religion, ethnicity, or any other group;
  • uses inappropriate, vulgar, obscene, or offensive language, or contains content unsuitable for minors;
  • disrupts the flow of discussion with spam, repetitive posts, or flooding the forum with excessive posts;
  • contains advertising or promotional material, or any content with a commercial intent without prior approval; and
  • imitates or falsely represents another person, entity, or organization, including using misleading usernames.

When using the Forum, you agree to observe our Forum Rules and Guidelines.

The determination of whether content violates these Content Standards and/or Forum Rules and Guidelines is at the sole discretion of PDA. However, this does not preclude the involvement of relevant courts or regulatory authorities, if necessary.

J. Enforcement and Moderation

PDA may investigate and prosecute violations of this Policy to the fullest legal extent. PDA may notify and cooperate with law enforcement authorities in prosecuting violations of the law and this Policy.

To ensure a healthy discussion environment, we may engage both human moderators and automated software to assist with the moderation of posts. While we strive for quick moderation, please note that neither human moderators nor the automated software is infallible. We ask for your patience and request that you do not repost the same content multiple times. Depending on the time of day and current news situation, there may be delays in post approvals.

If you believe someone has submitted content to the Forum in violation of this Policy, please report the post immediately. Our goal is not to stifle free expression, but to create a discussion environment where everyone feels comfortable participating.

We reserve the right to change, redact, and delete content on the Forum for any reason. Posts that violate this Policy or detract from the quality of the discussion may be removed. There is no legal right to have your post published. Similarly, there is no legal right to have posts deleted, as this may require the removal of entire discussion threads due to content dependencies.

Users who repeatedly violate this Policy will be banned from the Forum. In severe cases, user accounts may be permanently suspended, and re-registration may be prohibited.

K. Reliance on Information / No Sales Activity

The information on our Forum is for informational purposes only. It is not intended for distribution to or use by any natural or legal person in any country where the distribution or use would be in violation of local law or regulations, or where any registration requirement in this country would be enforced. Persons or entities to whom these prohibitions apply must not access and/or use this Forum.

IN PARTICULAR, THE INFORMATION REGARDING ANY DESIGNATED PRODUCT(S) OR SERVICE(S) ON THIS FORUM IS NOT AUTHORIZED FOR DISTRIBUTION, AND IS NOT INTENDED TO AMOUNT TO AN OFFERING OR ANY SALE IN THE UNITED STATES OF ANY COMMODITY, DERIVATIVE OR SECURITY IN ANY RESPECT. PDA FURTHER EXPRESSLY STATES THAT THE FORUM IS NOT A BULLETIN BOARD, MARKETPLACE, CONTRACT MARKET, OR OTHER SYSTEM OR VENUE FOR EXCHANGING ANY AMOUNT OF VALUE IN ANY RESPECT.

L. Third-party Content

Our Forum may contain content from third parties, including other users, bloggers, and third-party licensors. All statements and opinions expressed in these materials, as well as all articles, responses to questions, and other content, apart from the information provided by the us, are solely the opinions and responsibility of the individuals or entities providing those materials. These materials do not necessarily represent the views of PDA. We are not responsible or liable to you or any third party for the content or accuracy of any materials provided by third parties.

M. External Links

Our Forum contains links to websites of third parties (so-called “external links”), over whose content we have no influence. External links are provided solely as a convenience to you. We have no influence on the content of external links and for this reason we cannot accept any liability for the content or for any loss or damage that may arise from your use of them. The respective provider or operator of the external links is always responsible for the content of the external links and the linked websites. The access and use of external links is entirely at your own risk and subject to the terms and conditions of use for such websites.

The setting of external links does not mean that we adopt the content behind the external link as our own. A constant control of the external links is not reasonable for us without concrete evidence of legal violations. However, if we become aware of any legal violations, we will delete such external links immediately. We reserve the right to withdraw linking permission without notice.

Deeplinking or framing of the Forum or other techniques by which our Forum (or parts thereof) are integrated into third-party websites - in any form - are not permitted without our prior written approval.

N. Content Licensing

Between you and PDA, you remain solely responsible for content you submit to the Forum. You agree not to imply falsely that content you submit to the Forum is sponsored or approved by PDA. This Policy does not obligate PDA to store, maintain, or provide copies of content you submit.

BY SUBMITTING CONTENT TO THE FORUM RELATED TO SOFTWARE, YOU AGREE TO DEDUCATE YOUR CONTENT TO THE PUBLIC DOMAIN UNDER THE TERM AND CONDITIONS OF THE APACHE 2.0 OPEN SOURCE LICENSE.

BY SUBMITTING ANY OTHER CONTENT TO THE FORUM, YOU AGREE TO DEDICATE YOUR CONTENT TO THE PUBLIC DOMAIN UNDER THE CREATIVE COMMONS CC0 1.0 UNIVERSAL (CC0 1.0) PUBLIC DOMAIN DEDICATION. THIS DEDICATION ALLOWS ANYONE TO USE, MODIFY, AND DISTRIBUTE YOUR CONTENT FOR ANY PURPOSE WITHOUT REQUIRING PERMISSION FROM YOU.

When content you submit is removed from the Forum, whether by you or by PDA, our right to use the content under the CC0 1.0 Universal license remains unaffected as long as the content is retained in any of our backups, caches, or other systems.

Others who receive content you submit to the Forum may violate the terms on which you license your content. You agree that PDA will not be liable to you for those violations or their consequences.

O. Intellectual Property and Trademarks

The entire content (text, graphics, images, etc.), features, functionality, and structure of the Forum are the intellectual property of PDA, its licensors, or other partners listed in the imprint and is protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. The complete or partial reproduction, distribution, modification, linking or use for commercial or public purposes and any kind of exploitation outside the limits of copyright requires PDA’s prior written approval or the consent of the partners listed in the imprint.

Nothing in this Policy grants you a right to use PDA name or any of PDA trademarks, logos, domain names, other distinctive brand features, and other proprietary rights.

Accessing the Forum does not grant, nor should it be construed as granting, any license under our or any third party’s intellectual property rights.

PDA’s names and logos and all related product and service names, design marks and slogans are the trademarks or service marks of PDA or its licensors. Access to the Forum does not authorize anyone to use any name, logo or mark in any manner whatsoever without our prior written approval.

P. Warranties Disclaimer

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR ACCESS TO AND USE OF THE FORUM IS AT YOUR OWN RISK.

We cannot and do not guarantee or warrant that files available for downloading from the internet or the Forum will be free of viruses or other destructive code. THE AGGREGATE LIABILITY OF PDA AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS RELATING TO THE WEBSITE WILL BE LIMITED TO ONE HUNDRED SWISS FRANCS (CHF 100.00). THE LIMITATIONS AND EXCLUSIONS APPLY EVEN IF THIS REMEDY DOES NOT FULLY COMPENSATE YOU FOR ANY LOSSES OR FAILS OF ITS ESSENTIAL PURPOSE.

IF ANY PROVISION OF THIS SECTION IS OR BECOMES INVALID, THE REMAINING PROVISIONS SHALL REMAIN UNAFFECTED AND WILL BE REPLACED BY A VALID PROVISION THAT CLOSELY MATCHES THE ECONOMIC INTENT OF THE INVALID PROVISION.

R. Force Majeure

PDA is not liable for any damage, loss, delay, or inconvenience caused by circumstances beyond our reasonable control. Such circumstances include, but are not limited to, war, threats of war, riots, civil disturbances, terrorist activities, industrial disputes, natural or nuclear disasters, fires, airport closures, adverse weather conditions, utility service interruptions or failures, or actions by any local or national government.

S. Indemnification

You agree to defend, indemnify, and hold harmless PDA, its affiliates, licensors, service providers, and their respective officers, directors, members of the committee, secretaries, employees, contractors, agents, licensors, suppliers, successors, and assigns from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from or related to:

  • your violation of this Policy;
  • your use of the Forum, including but not limited to any use of the Forum’s content, services, and products not expressly authorized by this Policy, or your use of any information obtained from the Forum; and
  • any content you submit to the Forum, including but not limited to claims of intellectual property infringement, privacy violations, or other legal claims resulting from your submissions.

Both you and PDA agree to notify the other of any legal claims for which you might have to indemnify us as soon as possible. If PDA fails to notify you of a legal claim promptly, you will not have to indemnify us for damages that you could have defended against or mitigated with prompt notice.

You agree to allow PDA to control the investigation, defense, and settlement of legal claims for which you would have to indemnify PDA, and to cooperate fully with those efforts.

T. Entire Agreement & Severability

This Policy, along with any amendments or modifications made by PDA periodically, constitute the entire agreement between you and PDA regarding your access and use of the Forum. If any provision of this Policy is deemed invalid by a court of competent jurisdiction, that provision will be limited to the minimum extent necessary, and the remaining provisions will continue to be fully effective.

U. No Waiver

PDA’s failure to enforce any provision of this Policy does not constitute a waiver of its right to enforce that provision, any other provision, or this Policy as a whole in the future.

V. Assignment

You may not assign any of your rights, licenses, or obligations under this Policy without PDA’s prior written consent. Any attempt by you to do so will be void. PDA may assign its rights, licenses, and obligations under this Policy without any limitations and without prior consent.

W. Applicable Law and Place of Jurisdiction

All matters relating to the Forum and this Policy, including any dispute or claim arising from or related to them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of Switzerland, without regard to any choice or conflict of law provision or rule (whether of Switzerland or any other jurisdiction).

Any disputes, legal suit, action, or proceeding arising out of or related to this Policy or the Forum shall be subject to the exclusive jurisdiction of the Courts of Zug, ZG, Switzerland, subject to an appeal at the Swiss Federal Court. However, we retain the right to bring any suit, action, or proceeding against you for breach of this Policy in your country of residence or any other relevant country. You waive any objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

You agree that any dispute with us shall be resolved solely on an individual basis and not as a class action or any other representative proceeding. You agree that you cannot bring a claim as a class or representative action, nor on behalf of any other person or persons.

In the event of a dispute, you agree to maintain the confidentiality of all proceedings, including, but not limited to, any and all information gathered, prepared, and presented for the purposes of litigation or related to the dispute(s).
